2. Legal framework
This policy is governed by Law No. 29733, the Peruvian Personal Data Protection Act, its Regulations approved by Supreme Decree No. 003-2013-JUS, and any amending or complementary provisions.
3. Personal data we collect
We may collect the following data:
- (a) Identification and contact data (first and last name, ID type and number, email, phone, company and job title) provided through contact, quotation or registration forms.
- (b) Account and academic activity data on our learning platforms (username, course progress, grades, certificates).
- (c) Billing data required to process payments.
- (d) Browsing data collected through cookies and similar technologies (IP address, device type, pages visited).
4. Purposes of processing
We process your personal data in order to:
- (a) Handle enquiries, information requests and quotations.
- (b) Provide the contracted services (LMS hosting, consulting, course development, support and virtual training).
- (c) Manage user accounts, enrolments and the issuance of certificates.
- (d) Process payments and issue invoices.
- (e) Send commercial communications about our services and events, provided we have your prior consent.
- (f) Improve our website and services through statistical analysis.
- (g) Comply with legal obligations.
5. Consent
By providing your personal data through our forms or by registering on our platforms, you grant your free, prior, express, unequivocal and informed consent to the processing of your data for the purposes described. Consent for commercial communications is optional and may be withdrawn at any time.
6. Retention period
Personal data will be retained for as long as it is necessary to fulfil the purposes described, for as long as a contractual relationship remains in force, or for the periods required by applicable regulations (tax, accounting or otherwise).
7. Transfers and data processors
Industria Elearning does not sell or transfer personal data to third parties for commercial purposes. We may share data with providers acting as data processors, such as hosting and cloud infrastructure services, payment gateways and communication tools, only to the extent necessary to deliver our services and under confidentiality obligations. Some of these providers may be located outside Peru, which may involve cross-border data flows, carried out while ensuring adequate levels of protection.
8. ARCO rights
You may exercise your rights of Access, Rectification, Cancellation and Objection (ARCO) at any time, as well as withdraw your consent, by sending a request to ventas@industriae.pe with the subject "Derechos ARCO", attaching a copy of your identity document. We will respond within the timeframes established by applicable law. If you believe your request was not properly addressed, you may file a claim with the National Authority for the Protection of Personal Data of the Ministry of Justice and Human Rights of Peru.
10. Security measures
We apply reasonable technical, organisational and legal measures to protect your personal data against unauthorised access, loss, alteration or improper disclosure, including encryption in transit, access controls and internal confidentiality policies.
11. Minors
Our services are aimed at companies and institutions. Where our learning platforms are used by minors within institutional educational programmes, their data will be processed with the consent of their parents, guardians or the responsible institution, as applicable.
12. Changes to this policy
We may update this Privacy Policy to reflect regulatory changes or changes to our services. The current version will always be published on this page together with its update date.
